Agreement

These terms govern your use of Attesta, a customer feedback and review management platform for businesses. By creating an account, using the service, or authorising someone to use it on your behalf, you agree to these terms and our Privacy Policy. If you use Attesta for a business, you confirm you have authority to bind that business.

If you submit feedback as a customer

If you use a business's Attesta feedback form or review request page, you agree that the information you submit may be used by that business to manage its relationship with you, record feedback, follow up where appropriate, and maintain customer and review history. Attesta processes that information on the business's behalf as described in our Privacy Policy.

Eligibility and accounts

You must provide accurate account and business information, keep login details secure, and promptly update information that changes. You are responsible for all activity under your account, including activity by staff or contractors you invite. You must notify us if you suspect unauthorised access.

Your customers and legal compliance

You are responsible for the customer information you upload, the messages you send, and the purposes for which you use Attesta. You must comply with all laws that apply to your business and recipients, including privacy, data protection, electronic messaging, consumer protection, advertising, review, and industry-specific rules in New Zealand, Australia, the United Kingdom, the United States, and any other country where your customers are located.

Messaging rules

You must only send review requests, reminders, or other electronic messages to people where you have a lawful right to contact them. This may require express consent, inferred consent, an existing customer relationship, a soft opt-in, a legitimate interest assessment, or another lawful basis, depending on the country and recipient. You must not upload purchased, scraped, harvested, or unlawfully obtained contact lists. You must not bypass, hide, or interfere with unsubscribe or opt-out mechanisms.

Review integrity

You must not use Attesta to create fake reviews, impersonate customers, buy or sell reviews, offer incentives in exchange for reviews, require only positive reviews, suppress or threaten negative reviewers, misrepresent customer feedback, or otherwise manipulate ratings. If you ask customers for Google reviews or other public reviews, you must follow the relevant platform rules, including policies against fake, biased, incentivised, or selectively solicited reviews.

Acceptable use

  • Do not use Attesta to send spam, harassment, threats, deceptive messages, unlawful content, or discriminatory content.
  • Do not attempt to access accounts, systems, data, or integrations without permission.
  • Do not interfere with service security, rate limits, abuse controls, or deliverability protections.
  • Do not upload malware, exploit code, or content that infringes another person's rights.
  • Do not use Attesta for businesses or campaigns that are unlawful or require permissions you do not have.

AI and suggested content

Attesta may provide AI-generated classifications, summaries, insights, or draft replies. These are suggestions only. You are responsible for reviewing, approving, editing, and deciding whether to use any AI output. You must not use AI output to mislead customers, impersonate customers, fabricate reviews, or make claims you cannot verify.

Subscriptions, billing, and usage

Paid plans are billed according to the plan shown at checkout or in your account. Prices are in NZD unless stated otherwise. Your subscription renews until cancelled. You can cancel from Settings or by contacting support, and access normally continues until the end of the current billing period. Overage charges, usage limits, taxes, and payment terms apply as shown in the product, checkout, or invoice. Fees are non-refundable except where required by law or expressly agreed by us.

Third-party services

Attesta relies on third-party services such as hosting, authentication, email delivery, billing, AI providers, and Google integrations. Your use of connected services may also be subject to their terms and policies. We are not responsible for third-party platforms changing, suspending, limiting, or rejecting access, reviews, messages, APIs, or integrations.

Data protection

Each party will handle personal information in accordance with applicable privacy and data protection laws. Where Attesta processes customer information on your behalf, you authorise us to process it as needed to provide, secure, support, and improve the service, and as otherwise described in our Privacy Policy. You are responsible for giving required notices, obtaining required permissions, responding to your customers where legally required, and ensuring your use of Attesta is lawful.

Service changes and availability

We aim to provide a reliable service, but we do not guarantee uninterrupted or error-free operation. We may update, change, suspend, or discontinue features, integrations, limits, or plans. We may perform maintenance, apply security fixes, block abusive activity, or restrict access to protect the service or other users.

Suspension and termination

We may suspend or terminate access if you breach these terms, create legal or security risk, fail to pay fees, misuse customer data, send unlawful messages, manipulate reviews, or use the service in a way that may harm Attesta, users, recipients, providers, or the public. You may stop using Attesta at any time.

Disclaimers

Attesta is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee that Attesta will increase reviews, improve ratings, prevent negative feedback, avoid platform penalties, or meet every legal requirement for your particular business. You should get independent advice for legal, tax, regulatory, or industry-specific questions.

Liability

To the maximum extent permitted by law, Attesta will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, loss of profits, loss of goodwill, loss of data, business interruption, or third-party platform decisions. To the maximum extent permitted by law, our total liability for claims relating to the service is limited to the amount you paid Attesta for the service in the three months before the event giving rise to the claim.

Indemnity

You agree to indemnify Attesta against claims, losses, damages, liabilities, costs, and expenses arising from your customer data, messages, review practices, breach of these terms, misuse of the service, or violation of law or third-party rights.

Governing law

These terms are governed by the laws of New Zealand, unless mandatory consumer or data protection laws in another jurisdiction apply and cannot be excluded. The New Zealand courts will have non-exclusive jurisdiction for disputes relating to these terms or the service.

Changes to these terms

We may update these terms from time to time. If a change is material, we will take reasonable steps to notify account users. Continued use of Attesta after updated terms take effect means you accept the updated terms.
